Tink’s Magical Vacations - Terms and Conditions
Agreement for Users and Travelers
When you use Tink’s Magical Vacations as your vacation planning agency, you agree to the following terms, and you agree to convey the contents of this Agreement to your traveling family members or companion. Tink’s Magical Vacations, LLC ™ is independently owned and operated. Tink’s Magical Vacations’ website (“Site”) is a service offered by Tink’s Magical Vacations, LLC. This site is a private enterprise and is not affiliated with the Walt Disney Company, the Walt Disney World Resort, Disney Cruise Line, Aulani, Adventures by Disney or any of
its affiliates or designates, nor is it affiliated with other Travel Suppliers as applicable. These Terms of Use describe the terms and conditions applicable to your access and use of the Site and our Agency’s services. We may amend these Terms of Use at anytime by posting the amended Terms of Use on our Site, and users are deemed to be apprised of and bound by any changes to the Terms of Use. We may make changes in the services described in the Site at any time.
Responsibility: Tink's Magical Vacations, LLC ("We") act as an agent for the airlines, tour operators, cruise lines, lodging providers, car rental companies, ground operators, and any other suppliers of travel services shown on your itinerary. We are not responsible for the acts of omissions of such suppliers or their subcontractors or their failure to provide services, adhere to their own schedules, or honor their contracts. The content available on the Site and also on our social media channels (including and not limited to Facebook, Twitter, Pinterest, Instagram and Youtube) is intended to be a general information resource and is provided solely on an “AS IS” and/or “AS AVAILABLE” basis. You are encouraged to confirm the information contained herein with Tink’s Magical Vacations, LLC directly. You should not construe Tink’s Magical Vacations’ publication of the content on the Site and on our social media channels as a warranty or guarantee of the quality or availability of any travel package, plans, or advice.
Hazards: We have no special knowledge regarding foreign entry requirements, unsafe conditions, health hazards, weather hazards, supplier bankruptcies, or the suitability for disabled persons of any portion of your tour. You hereby release us from any claims resulting in whole or in part from any problem covered in this paragraph.
Communicable Diseases: Including Covid-19: I knowingly and freely assume all such risks, both known and unknown, from communicable diseases including Covid-19. I hereby release and hold harmless Tinks Magical Vacations, and its officers and agents.
Delays: Travel delays are very common today. If your flight is delayed for any reason, the airlines are not required by law to pay for your en route expenses, such as meals, hotels, taxis, and phone calls. Please be advised that we strongly recommend that you arrive at your destination in a timely fashion as any trip interruption is your responsibility.
Check Your Destination Reservation: As soon as you receive your deposited reservation confirmation, check it thoroughly to make sure it is correct as to full legal names, dates of birth, dates of travel, arrival and departure times.
Package Trips: If you book a trip, we must collect the Travel Supplier’s required deposit to confirm the reservation. The amount of the deposit, the refund allowed, and the times for canceling may vary according to the Travel Supplier. Our role is strictly limited to facilitating the booking. The Terms and Conditions for your Destination Supplier is detailed in your reservation confirmation. Please read the Terms and Conditions carefully as this is your contract with your Travel Supplier (Walt Disney World, Disney Cruise Line, Adventures by Disney, Disneyland and Aulani: A Resort and Spa) and other Travel Suppliers, as applicable.
Payments: We do not accept payments or charge the traveler or client. We do not charge credit cards directly. All credit card or debit card transactions are processed directly by the Supplier. We do not accept cash, travelers checks, or traveller coupons. Should a refund be issued later, these refunds will be processed by the Travel Supplier and will go back on the original credit cards used for the original transactions. Also note that if a Gift Card is used, you must save the gift card in case the Travel Supplier issues a refund. Gift card refunds will go back onto the original cards.
Final Payment: For all vacation trips, you must have made full payment before we release any tickets or documents provided by the Travel Supplier. Where possible, the Travel Supplier will mail or email the documents to your home address. Please make sure that your address is current. We are not liable for postal delivery errors and issues.
Vacation Protection Insurance: Tink’s Magical Vacations, LLC is not a licensed insurance brokerage. Our agents can not advise you on the pros and cons of insurance. You should make the right decision about travel insurance based on your family’s particular and unique needs. If you would like to purchase the Travel Supplier's Vacation Protection Plan, notify your Tink’s planner to send you the brochure about the plan and instruct them in writing that you want to add it on. No Vacation Protection Plans by a Travel Supplier can be added on after final payment is made. Please realize that the Vacation Protection Plan is nonrefundable. Should you have specific questions about a Travel Supplier's Vacation Protection Plan, there is a number on the Plan brochure that you can call to speak with a policy specialist. Tink’s planners can not answer any insurance questions.
OnBoard Credit: Tink's Magical Vacations offers an onboard credit program for Disney Cruise Line only. We will offer you an onboard credit for your Disney Cruise Line sailing based upon the final commissionable voyage fare of your cruise (as determined by Disney Cruise Line), excluding taxes, transfers, insurance, port charges, supplier fees/withholdings, or other non-cruise elements of your vacation (for example: airfare, hotel bookings, etc). Your agent will tell you what your Tink's Magical Vacations onboard credit amount will be for your sailing after your reservation has been deposited. The amount of your onboard credit will be redetermined when any change to the booking is made prior to the paid in full date of your sailing. Any upgrades or changes made at the embarkation port are not factored into the onboard credit amount and will not be redetermined. The Tink's Magical Vacations onboard credit can only be used while on the ship, and any unused onboard credit at the end of the cruise is not redeemable for cash or credit. The Tink's Magical Vacations onboard credit will be canceled if your cruise booking is canceled. Tink's Magical Vacations reserves the right to cancel or change this program at any time. Tink's Magical Vacations onboard credits are only valid so long as Disney Cruise Line will accept them.
Last Minute Vacations: Tink’s Magical Vacations will not book last minute vacations (30 days or less) due to concerns about fraudulent activity.
Information on Site: You agree not to use or authorize the use of this information for any purpose other than personal use, and not to engage or authorize anyone to engage in the resale, redistribution, and use of the information on this website for commercial
purposes. Third party links and pointers are included solely for your convenience, and do not constitute any endorsement by us and/or our suppliers. Any software that is on this Site including HTML codes and software made available to download from this website (“Software”) is our copyrighted work or the copyrighted work of our suppliers or licencors. Other product and company names mentioned herein may be
the trademarks of their respective owners.
Power of Attorney: As our client, you hereby appoint us to be your attorneys-in-fact to sign credit card authorizations for said purchases whenever any of them receives an Internet booking request reasonably believed to be from you or someone acting on your behalf, requesting those purchases be charged to this credit card account. You agree that you will pay for all such purchases and will not hold us responsible for any of our actions pursuant to this power of attorney.
Exclusive Jurisdiction: All suits in connection with, or incident to, this Agreement shall be litigated, if at all, in the courts of the Country of United States, State of Connecticut, Hartford County, to the exclusion of other courts of any other state. No warranties: The content, code, access, and other features of this site are provided “AS IS” and without warranties of any kind either express or implied, including, but not limited to, warranties of accuracy, reliability, merchant ability, fitness for a particular purpose, and non-infringement. We do not warrant that any such features will operate uninterrupted or in an error-free fashion, that defects will be corrected, or that this site or the server are free of viruses or other harmful components. Applicable law may not allow exclusion of implied warranties, so the above exclusion may not apply to you.
No Consequential Damages: In no event will we be liable for any direct, indirect, incidental, or consequential damages, including without limitation lost profits and cost of procurement of substitute products, arising out of your use or inability to use any content or features, or your failure to access or click through access any content or features, even if we have been advised of the possibility of such damages. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation and exclusions may not apply to you.
Indemnity: You agree that Tink's Magical Vacations, LLC shall not be held liable for any errors, omissions, delays, failures, or damages caused by third parties involved in providing services, products, or information related to the services or products offered. This includes, but is not limited to, contractors, vendors, suppliers, or any other third-party entities such as but not limited to Disney, Universal, Royal Caribbean, Virgin.
You acknowledge and agree that Tink's Magical Vacations, LLC is not responsible for the actions, inactions, or negligence of any third party, nor for any damages or losses resulting therefrom. Any claims or disputes arising from third-party actions shall be directed solely to the third party in question.
By engaging with Tink's Magical Vacations, LLC, you agree to indemnify and hold Tink's Magical Vacations, LLC harmless from any claims, liabilities, or damages arising from the acts or omissions of third parties.
